Terms of Use
This Terms of Use agreement applies to Hello CREATIVITYSM through the websites that it operates: www.hellocreativity.com and www.hellocreativity.org (hereafter, "Websites").
When using the Websites, you acknowledge and agree that:
(a) the Websites provide a social networking service that allows people to submit artwork to the site in order to enable public access to the artwork, with the intent to provide a means for children to receive positive feedback on their artwork and thereby provide an opportunity for the children to become more confident in their artistic abilities. The services offered by the Websites are provided for general information purposes only and provides a general discussion about the posted artwork should and may not be relied on, represented to be or used as a substitute for securing appropriate advice or professional consultation;
(b) the Websites provide a forum for the public to discuss the content of the postings to the site and that nothing posted to the Websites constitutes the official opinion, position or view of Hello CREATIVITY;
(c) Hello CREATIVITY is not responsible for the information provided in the Websites’ content and postings and/or for any action taken or activity that occurs as a result of the information provided on the Websites; (d) Hello CREATIVITY does not discriminate based on race, color, religion, sex, national origin, age, disability, sexual orientation or group affiliation;
(e) artwork entries and contributions are evaluated on artistic merit as determined by the Websites’ editors;
(f) contributions will not be accepted if deemed obscene, lewd, excessively violent, harassing, sexually explicit, discriminatory, inciting hate, or containing nudity or otherwise objectionable subject matter;
(g) contributions may not contain telephone numbers, street addresses, or last names of any person under the age of 18 years of age;
(h) contributions will be accepted and posted at the sole discretion of the Hello CREATIVITY editors, whose decision is final;
(i) contributions may not be acknowledged or returned;
(j) despite the prohibitions listed above, information provided may contain inaccurate, inappropriate, offensive or sexually explicit material, and Hello CREATIVITY, its domain name owner, directors, officers, employees, agents, and editors assume no responsibility or liability for this material;
(k) Hello CREATIVITY reserves the right, in its sole discretion, to reject, refuse to post or remove any posting, or to restrict, suspend, or terminate access to all or any part of the Websites’ services at any time, for any or no reason, with or without prior notice, and without liability.
If you become aware of misuse, please contact support@hellocreativity.com or click on the email link at the bottom of all pages on the Websites.
When contributing to the Websites you agree that:
(a) the posting of your Content on or through the Websites’ services does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person;
(b) your contributions to the Websites will be licensed to the general public under the Creative Commons Attribution Attribution-NonCommercial-NoDerivs 2.5 license;
(c) attribution for your contributions will be given, to the fullest extent permitted by the applicable law, to the Websites in the form of "Hello CREATIVITY."
In addition to and without limiting the license granted under Creative Commons Attribution Attribution-NonCommercial-NoDerivs 2.5 license referenced above, you agree to license, upon submission, any and all content that you contribute to the Websites’ content repository to Hello CREATIVITY on a non-exclusive, royalty-free, perpetual basis for Hello CREATIVITY to use in any manner and for any purpose, including without limitation to reproduce, distribute, make derivative works, publicly display, publicly perform and publicly digitally perform for commercial and noncommercial purposes, in any format.
You represent and warrant to Hello CREATIVITY, its directors, officers, employees and agents that you have the right and authority to grant the licenses described above and you indemnify Hello CREATIVITY, its domain name owner, directors, officers, employees, agents, and editors from and against any and all direct losses, costs, expenses and liabilities suffered or incurred by Hello CREATIVITY as a result of your breach of this warranty.
I HAVE READ THIS AGREEMENT AND AGREE TO ALL OF THE PROVISIONS CONTAINED ABOVE.
Privacy Policy
This Privacy Policy explains the collection, use, and disclosure of "personal information" by Hello CREATIVITYSM through the websites that it operates: www.hellocreativity.com and www.hellocreativity.org (hereafter, "Websites"). “Personal information” refers to information that is used to identify a person, such as name and email address; any personal information that Hello CREATIVITY collects is handled as detailed in this Privacy Policy.
Hello CREATIVITY collects your personal information in the following functions of the Websites:
1. The Sign-Up for Email List page collects First Name, Zip Code and Email address;
2. The Upload Artwork page requests that the following be provided: Child's First Name, Child's Age, Email address, and uploaded files representing the Child's creative work.
We use the personal information you provide to us as when you send us emails, sign-up for the Email List, or upload the Entry Package in order to respond to your Entry Package, to reply to your email or to send you communications related to the Websites.
Hello CREATIVITY does not collect personal information with the intent to sell or otherwise disclose personal information to third parties. We may share personal information in two instances, as appropriate:
Hello CREATIVITY may share personal information with website partners, service providers, and contractors in order to support, maintain, or enhance the features and functionality of the websites. Secondly, we may share personal information with third parties such as the government or other entities when required to by law or as required by court order.
Hello CREATIVITY collects and displays only the First Name and grade level alongside the child’s artwork, and displays the Name and IP address of those who post comments attributed to the artwork.
